Introduction
Justices of the Peace (Magistrates) are the first level of the judicial system.
They handle the majority of minor civil, criminal, and administrative cases.
They belong to the courts of general jurisdiction.
Legal Framework
The status is regulated by Federal Law No. 188-FZ (1998).
They are judges of the constituent entities (regions) of Russia.
They exercise their powers on behalf of the Russian Federation
Requirements for Candidates
Age: At least 25 years old.
Education: Higher legal degree (Bachelor/Master/Specialist).
Experience: At least 5 years of legal practice.
Examination: Must pass a qualifying exam and get approval.
Appointment and Term
Justices are appointed (or elected) by the regional legislative assembly.
The first term of office is usually 3 years.
Subsequent terms can be 5 years or more (depending on regional law)
Civil Case Jurisdiction
Divorce cases (if there is no dispute about children).
Property division (if the claim value is under 50,000 RUB).
Small claims and consumer protection issues.
Issuing judicial orders (for debt collection).
Criminal Case Jurisdiction
Minor crimes where the maximum penalty does not exceed 3 years of imprisonment.
Examples: Minor battery, petty theft, or threats.
They aim for reconciliation between the parties when possible.
Administrative Offenses
Traffic violations (e.g., DUI - driving under influence).
Public order violations.
Minor tax and labor law violations.
Relationship with District Courts
District courts act as the appellate court for Justices of the Peace.
Any decision by a Justice of the Peace can be appealed to a higher district judge.
