Judicial system of Anglo-Saxon law

Historical context

To understand the Anglo-Saxon law we need to look at its historical context. Anglo-Saxon law has its roots in the ancient customs and traditions of the Germanic race, which developed in the territory of modern England in the 5th and 6th centuries.

An important moment in the history of Anglo-Saxon law was the conquest of England by the Normans in 1066. The Normans, led by William the Conqueror, brought their legal system to England, which, mixed with Anglo-Saxon law, created the basis for the development of the Anglo-Saxon law.

One of the most important steps in the development of Anglo-Saxon law was the creation and development of traditional rights, formed on the basis of court decisions and precedents. Court decisions became the basis for the development of case law.

Features of Anglo-Saxon family protection

The Anglo-Saxon legal family has a number of features that distinguish it from other legal systems:

Case law

One of the main features of the Anglo-Saxon legal family is case law. Case law is based on court decisions, which create precedents and become the source of law. Judicial decisions are made by judges based on the circumstances of a particular case and are applied in future trials with similar circumstances. This allows judges to make decisions based on existing precedents and ensures stability and predictability in the legal system.

Customary law

In the Anglo-Saxon legal family, common law is given great importance. Customary law is formed on the basis of generally accepted norms and customs that develop in a society over time. It is based on traditions and customs, and not on legislative acts. Common law plays an important role in the Anglo-Saxon legal system and complements case law.

Separation of powers

The Anglo-Saxon legal family is based on the principle of separation of powers. Power is divided between the legislative, executive and judicial branches of government. The legislative branch makes laws, the executive branch enforces them, and the judicial branch applies laws and resolves disputes. This provides balance and control in the legal system.

Independence of the judiciary

The judicial system in the Anglo-Saxon legal family is characterized by independence. Judges are independent of the influence of other branches of government and make decisions based on the law and precedents. This ensures the fairness and independence of the judiciary.

Thus, the Anglo-Saxon legal family is distinguished by case law, the importance of common law, the separation of powers and the independence of the judiciary. These features ensure stability, predictability and fairness in the legal system.
